Summary

This class proceeding filed before the Federal Court is based firstly on allegations of double labelling concerning several products offered by the defendant Costco Wholesale Canada and secondly, this action denounces the practice of the Defendant of presenting false or misleading indications concerning 1) the absence of other charges and 2) the absence of indication during an online purchase to the effect that the product is also available in store.

Proposed Class

All persons in Canada who, since December 23, 2022, have purchased a product from Costco via the latter’s mobile application or the Costco.ca website and who have paid an amount greater than that displayed in Costco stores for the same product.

Conclusions sought:

Equivalent damages between online and in-store prices for the same product

Reimbursement of investigation and prosecution costs.
