Superior Court orders Air Canada to compensate passengers (February 2026)
The court concluded that Air Canada committed a breach of contract by transferring passengers from its scheduled flights to its subsidiary, Air Canada Rouge, without adequate compensation following the grounding of the Boeing 737 MAX aircraft in March 2019.

Notice as of February 26 , 2021
The Application to Institute Proceedings was filed to the court on February 26, 2021.
Following the authorization of our class action, we filed the Application to Institute Proceedings before the Superior Court, as in any other regular case. The court will have to determine whether Air Canada’s liability is retained, and if so, how to assess each person’s eligibility for compensation, as well as the quantum of this compensation.
Notice as of September 29, 2020
On September 28, 2020, the court authorized the exercise of the class action.
The parties will be convened within 60 days of this judgment to deal with the publication of a notice to the members of the Class.

CONDEMN the defendants to pay to the plaintiff and to the members of the Group the sum equivalent to 15% of the total price of the tickets, with interest at the legal rate plus the additional indemnity provided for in article 1619 C.c.Q. calculated from the date of service of the class action
