Paquette v. Tesla

Summary

This class action lawsuit, based on civil liability and the Consumer Protection Act, seeks compensatory damages from the Defendant. These damages aim to reimburse repair costs and reduce contractual obligations related to the purchase or lease price of the vehicles, in addition to claiming punitive damages.

The legal action is founded on the systemic and premature failure of the heat pump system, the failure to disclose risks associated with this technology, and the unenforceability of an external arbitration agreement that was not brought to the Class Members’ attention at the time the contract was formed.


Proposed Class

Any consumer residing in Quebec who is or was the owner or lessee of a Tesla brand automobile from the following models and years:

  • Model S (2021 to present);
  • Model 3 (2021 to present);
  • Model X (2021 to present);
  • Model Y (2020 to present);
  • Cybertruck (2023 to present);
  • Or any other group to be determined by the Court.

Conclusions sought:

  • ORDER the Defendant to reimburse Class Members for expenses incurred for the repair or replacement of their vehicle’s heat pump;
  • ORDER the Defendant to pay Class Members an amount as a reduction of their obligations regarding the purchase or lease price of their vehicle;
  • CONDEMN the Defendant to pay Class Members an amount to be determined for incidental expenses incurred due to the vehicle’s defect, as well as for trouble, inconvenience, and loss of enjoyment resulting therefrom;
  • CONDEMN the Defendant to pay Class Members an amount to be determined as punitive damages.
